These Terms & Conditions (“Terms”) govern your membership in and use of the MacroRx+ nutrition coaching program and related services. Please read them carefully. By enrolling in MacroRx+ and agreeing to these Terms, you enter into an agreement with Power of Margin, LLC, a Georgia limited liability company doing business as MacroRx+.
Table of Contents
1. About MacroRx+
These Terms & Conditions (“Terms”) govern your membership in and participation in the MacroRx+ nutrition coaching program (“MacroRx+” or the “Program”), provided by Power of Margin, LLC, a Georgia limited liability company doing business as MacroRx+ (“we,” “us,” or “our”).
MacroRx+ is a nutrition coaching, education, and accountability program designed to help members work toward weight-management, body-composition, nutrition, and related lifestyle goals.
Depending on your membership level, MacroRx+ may provide personalized calorie and macronutrient targets, nutrition tracking and accountability, coach review and feedback, periodic adjustments to your targets, access to a private member community, educational materials, and other coaching resources.
By purchasing a MacroRx+ membership and agreeing to these Terms, you enter into a binding agreement with Power of Margin, LLC.
2. Your Macro Prescription
MacroRx+ refers to your personalized calorie and macronutrient targets as your “Macro Prescription.”
“Macro Prescription” is a MacroRx+ program and branding term. It means personalized nutrition-coaching recommendations concerning your calorie and macronutrient targets.
A Macro Prescription is not a medical prescription, medical treatment, diagnosis, or prescription issued by a physician or other licensed healthcare provider.
Your Macro Prescription may be reviewed periodically and adjusted when MacroRx+ determines that an adjustment is appropriate based on the information you provide, your progress, and the coaching methods used by the Program.
3. Nutrition Coaching, Not Medical Care
MacroRx+ provides nonmedical nutrition coaching, education, feedback, accountability, behavior-change support, and individualized nutrition recommendations for general health, wellness, and nonmedical weight control. MacroRx+ does not provide medical nutrition therapy, medical diagnosis, medical treatment, emergency medical services, or other healthcare services that must be performed by a licensed healthcare professional.
Information and coaching provided through MacroRx+ are not intended to replace advice, diagnosis, or treatment from your physician or another appropriately qualified healthcare professional.
You should not disregard professional medical advice, delay seeking medical care, discontinue prescribed treatment, or change medication based upon information provided through MacroRx+.
If you believe you may be experiencing a medical emergency, call 911 or seek appropriate emergency medical care immediately. MacroRx+ is not an emergency medical service.
You are responsible for determining, in consultation with an appropriate healthcare professional when necessary, whether participation in a nutrition or weight-management program is appropriate for you.
You participate in the Program voluntarily and remain responsible for your own food, lifestyle, health, and healthcare decisions.
MacroRx+ may determine that a particular medical or health circumstance is outside the reasonable scope of the Program. We may request medical clearance or decline, modify, suspend, or discontinue coaching when we reasonably determine that continued participation may be inappropriate or outside our scope.
4. Eligibility
You must be 18 years of age or older to participate in MacroRx+.
MacroRx+ is not currently available to someone who:
- is under 18 years old;
- is currently pregnant; or
- has a current or active eating disorder.
MacroRx+ does not provide intentional calorie-deficit or weight-loss coaching during pregnancy.
A history of an eating disorder does not necessarily make you ineligible. MacroRx+ may review the circumstances individually and may require consultation with or clearance from an appropriate healthcare professional before determining whether participation is appropriate.
Being postpartum or breastfeeding does not automatically make you ineligible. Depending on your circumstances, MacroRx+ may recommend or require consultation with an appropriate healthcare professional.
If you become pregnant or develop circumstances that could materially affect whether nutrition or weight-management coaching is appropriate for you, you agree to notify MacroRx+.
4.1 Initial Eligibility Review
The detailed MacroRx+ intake is completed after enrollment.
If your initial intake establishes that you were ineligible when you enrolled because you were under 18, pregnant, or had an active eating disorder, MacroRx+ will cancel your membership, will not begin coaching, and will refund your initial membership payment.
Other health or suitability concerns identified through intake will be considered individually. MacroRx+ may request medical clearance, modify the coaching we can provide, or determine that the Program is not appropriate for you.
5. Your Intake and Information
You agree to provide reasonably accurate and complete information when completing your intake and participating in MacroRx+.
We may request information reasonably related to your coaching, including your age, height, weight, goals, activity level, food allergies or avoidances, dietary preferences, lifestyle, nutrition tracking, and progress.
We may also ask limited health-related questions when reasonably necessary to determine whether participation is appropriate or whether consultation with a healthcare professional may be appropriate.
You are not required to disclose diagnoses, medications, pregnancy status, eating-disorder history, or other sensitive medical information publicly to the MacroRx+ member community. Sensitive information requested by MacroRx+ should be communicated using the private communication methods made available for that purpose.
6. Membership Services
6.1 Regular MacroRx+ Coaching
Regular MacroRx+ coaching is an accountability-based nutrition coaching program.
Regular membership generally includes:
- a personalized Macro Prescription;
- access to the private MacroRx+ member community;
- ongoing coach feedback on your daily nutrition reporting;
- regular progress and accountability review; and
- weekly review of your Macro Prescription, with adjustments when appropriate.
Coach feedback depends upon your reporting and individual circumstances. It may range from a brief acknowledgment that you are on target to more specific nutrition or behavioral suggestions.
MacroRx+ does not promise a particular length of response, a particular response time, or that your Macro Prescription will change every week. Sometimes the appropriate coaching decision is to leave your current targets unchanged.
If you do not submit the information needed for review, MacroRx+ may be unable to provide meaningful feedback or adjustments.
6.2 Macro Maintainer
Macro Maintainer is a reduced-intensity membership intended for qualifying members who have reached an appropriate maintenance phase and want continued accountability to help maintain their progress.
Macro Maintainer members generally continue tracking their nutrition but report for coaching review once per week rather than daily.
Macro Maintainer generally includes continued member-community access, weekly accountability reporting, weekly coach review, and adjustments to the member’s Macro Prescription when appropriate.
Eligibility requires at least six months of continuous active regular MacroRx+ membership, continued active membership at the time of transition, reaching a stage MacroRx+ considers appropriate for maintenance, and approval by MacroRx+.
Completing six months of membership does not automatically entitle a member to Macro Maintainer. MacroRx+ determines whether and when the transition is appropriate.
7. Your Responsibilities
MacroRx+ is a collaborative coaching program. Your results depend substantially upon your choices, circumstances, consistency, and participation.
You are responsible for making your own food and lifestyle choices; tracking your food with reasonable accuracy; providing reasonably accurate weight and progress information; reporting as appropriate for your membership level; providing information reasonably needed for coaching; communicating concerns that may affect your ability to participate safely; and obtaining appropriate healthcare when needed.
Perfect adherence is not required. MacroRx+ recognizes that sustainable nutrition and behavior change take place in the real world.
However, the quality and usefulness of coaching depend substantially upon the accuracy and consistency of the information you provide.
8. Results Vary
Individual results vary.
MacroRx+ does not promise that you will lose a particular amount of weight, lose weight at a particular rate, achieve a particular body composition, reach a target weight within a particular timeframe, maintain weight loss, or achieve another specific health, fitness, or nutrition outcome.
Testimonials, transformations, examples, statistics, and experiences of other members describe individual experiences and should not be interpreted as promises that you will achieve the same or similar results.
9. Membership Fees and Automatic Renewal
MacroRx+ memberships are recurring subscriptions unless expressly stated otherwise during checkout.
The price, billing interval, and renewal terms applicable to your membership are displayed before you complete your purchase.
Depending upon the membership you select, you may be billed monthly, every three months, annually, or according to another billing interval disclosed before purchase.
Your membership will automatically renew at the end of each applicable billing period and your payment method will be charged unless you cancel before the next renewal charge.
By purchasing a recurring membership, you authorize MacroRx+ and its payment processor to charge the payment method you provide for recurring membership fees until the membership is canceled or otherwise terminated.
You are responsible for maintaining a valid payment method.
10. Cancellation
You may cancel your MacroRx+ membership at any time to prevent future renewals.
MacroRx+ will provide an online cancellation method or another reasonably accessible electronic cancellation method as required by applicable law.
Cancellation stops future recurring charges. Unless otherwise stated, cancellation does not terminate access for a membership period you have already paid for; you may continue using the applicable membership services through the end of that paid period.
Cancellation does not ordinarily create a refund for amounts already paid.
Failure to participate, track food, report to your coach, access the community, or otherwise use the Program does not cancel your membership.
11. Failed Payments and Nonpayment
If a recurring payment fails, MacroRx+ may provide a reasonable opportunity to update your payment information before membership services are suspended.
If payment remains unresolved, MacroRx+ may suspend access to coaching, Macro Prescription reviews or adjustments, member-only content, and the private member community until payment is brought current.
Repeated or unresolved nonpayment may result in termination of membership.
12. Refund Policy
Except for the initial eligibility refund described in Section 4 or where otherwise required by law, membership payments are generally non-refundable once charged.
MacroRx+ does not offer a general satisfaction or results-based refund program.
MacroRx+ may choose to provide a refund, credit, membership extension, or other accommodation when circumstances warrant. Providing a discretionary accommodation in one situation does not require MacroRx+ to provide the same accommodation in another situation.
13. Pricing and Changes to Membership
MacroRx+ may change membership prices from time to time.
If a price change will apply to an existing recurring membership, MacroRx+ will provide advance notice before the changed price is charged as required by applicable law. You may cancel before the changed price takes effect.
MacroRx+ may choose to maintain older or “grandfathered” pricing for particular members or groups. Providing grandfathered pricing does not require MacroRx+ to offer it to other members or maintain it indefinitely unless we have expressly agreed otherwise.
MacroRx+ may also reasonably modify Program methods, features, content, technology, tracking processes, community platforms, communication methods, staffing, and other aspects of how the Program is delivered.
We will not use this provision to materially deprive you of the core coaching service you purchased without taking reasonable steps appropriate to the circumstances.
14. Coaches, Technology, Automation, and AI
Your membership is with MacroRx+, not with a particular individual coach.
MacroRx+ may use owners, employees, contractors, additional coaches, software, automation, artificial intelligence-assisted tools, and other technology to provide, administer, and improve the Program.
The use of technology or automation means that not every communication, analysis, recommendation, or administrative action will necessarily be personally created from beginning to end by one individual.
MacroRx+ remains responsible for providing the Program described by your membership.
15. Private Member Community and Member Conduct
MacroRx+ may provide access to a private online member community through one or more platforms selected by MacroRx+.
The community is intended for accountability, encouragement, discussion, and member support.
You agree to respect the privacy of other members. Without that member’s permission, you may not screenshot, download, reproduce, publish, distribute, forward, publicly disclose, or otherwise share another member’s private posts, photographs, progress information, personal information, or other member content outside the community.
You may not use the Program or community to harass, threaten, abuse, exploit, improperly solicit, or materially disrupt other members.
MacroRx+ may moderate the community, remove content, and restrict or terminate community access when reasonably necessary to protect members, operate the Program, or enforce these Terms.
Information you voluntarily post to the member community will be visible to other people authorized to access that community. No online community or third-party platform can be guaranteed to be completely confidential or secure.
16. Your Content, Testimonials, and Privacy
You retain ownership of original content you create and submit, including your photographs, comments, food logs, and progress information.
You give MacroRx+ permission to access, process, display, and use content you submit to the extent reasonably necessary to provide, administer, and operate the Program and member community.
Participation in MacroRx+ does not give us blanket permission to use your name, likeness, testimonial, transformation, before-and-after photographs, or success story for advertising or promotional purposes.
If MacroRx+ wants to feature you or your results for marketing purposes, we will seek separate permission or an appropriate release.
Our collection, use, disclosure, retention, and protection of personal information is described in our Privacy Policy. Additional information regarding nutrition, body composition, wellness, and other consumer health data is provided in our Consumer Health Data Privacy Policy.
17. MacroRx+ Intellectual Property
MacroRx+ and its licensors retain their rights in MacroRx+ branding, program materials, written materials, videos, graphics, educational content, tools, resources, and other proprietary content.
Your membership gives you a limited, personal, non-exclusive, non-transferable right to use those materials for your own participation in MacroRx+.
Without written permission from MacroRx+, you may not reproduce or republish member-only materials; distribute them to nonmembers; share access to member-only content; sell or sublicense MacroRx+ materials; substantially copy or duplicate the Program; use MacroRx+ proprietary materials to provide coaching or services to others; or commercially or competitively exploit MacroRx+ materials.
Nothing in this section prevents you from using the knowledge and healthy habits you personally learn through MacroRx+ in your own life.
18. Third-Party Services and Communications
MacroRx+ may use third-party services for functions such as payments, websites, communications, community interaction, food tracking, analytics, and other Program functionality.
Those services may have their own terms, privacy policies, technical requirements, and availability. MacroRx+ may change the services or platforms used to deliver the Program.
MacroRx+ is not responsible for an outage, security incident, account restriction, or technical failure caused solely by an independent third party outside our reasonable control.
If a third-party failure materially prevents us from providing your purchased coaching service for an extended period, MacroRx+ may provide the service through another method or determine an appropriate accommodation.
By maintaining a membership, you agree to receive electronic communications reasonably necessary to provide or administer your membership, including billing, payment, account, coaching, Program, service-change, and Terms notices.
Consent to receive promotional or marketing communications is separate from these necessary membership communications.
19. Suspension or Termination
MacroRx+ may suspend or terminate a membership for reasons including nonpayment, abusive or threatening conduct, harassment, serious or repeated violations of another member’s privacy, unauthorized distribution of MacroRx+ materials, fraud, misuse of the Program, material disruption of the member community, or another material violation of these Terms.
If membership is terminated because of your misconduct or material breach, MacroRx+ is not required to refund unused prepaid membership fees except where required by law or where MacroRx+ chooses otherwise.
MacroRx+ may also decline, modify, suspend, or terminate coaching if we reasonably determine that continuing to provide nutrition coaching is inappropriate or outside the scope of the Program, including because of a medical or health circumstance.
Any refund, credit, extension, or other accommodation in such circumstances will be determined by MacroRx+ based on the circumstances, subject to applicable law.
20. Availability and Limitation of Liability
MacroRx+ does not promise uninterrupted availability or a particular response-time service level.
Temporary interruptions resulting from illness, emergencies, vacations, maintenance, technology failures, personnel changes, or similar circumstances do not by themselves constitute a breach of these Terms.
MacroRx+ will not be responsible for delays or failures caused by circumstances outside its reasonable control, including widespread Internet or infrastructure failures, natural disasters, governmental actions, major third-party outages, or similar events.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POWER OF MARGIN, LLC, MACRORX+, AND THEIR OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR PARTICIPATION IN MACRORX+ OR USE OF THE PROGRAM.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF POWER OF MARGIN, LLC AND MACRORX+ FOR CLAIMS ARISING FROM OR RELATING TO YOUR MEMBERSHIP OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO MACRORX+ DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
21. Changes to These Terms
MacroRx+ may update these Terms.
Minor changes that do not materially affect members’ rights or obligations—such as correcting typographical errors, updating links, or clarifying language—may be made without requiring renewed acceptance.
If we make a material change to these Terms that applies to existing members, MacroRx+ will provide reasonable advance notice and will require affected existing members to review and affirmatively accept the revised Terms before continuing member-only coaching or Program services under the revised Terms.
When renewed acceptance is required, silence alone will not constitute affirmative acceptance.
If you do not agree to materially revised Terms, you may cancel your membership. MacroRx+ may require acceptance of the then-current Terms before continuing to provide member-only coaching or Program services, while providing reasonable means to review the Terms, manage your account, cancel your membership, and contact us.
22. Governing Law and General Terms
These Terms and your membership are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law provides otherwise.
Any dispute that cannot be resolved informally may be brought in a court of competent jurisdiction as permitted by applicable law.
These Terms, together with the applicable checkout disclosures, Privacy Policy, and any policies expressly incorporated into these Terms, constitute the agreement governing your MacroRx+ membership.
If any provision is found invalid or unenforceable, it will be enforced to the maximum extent legally permissible and the remaining provisions will remain in effect.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.
