MacroRx+ Consumer Health Data Privacy Policy

Power of Margin, LLC d/b/a MacroRx+ (“MacroRx+,” “we,” “us,” or “our”) provides nonmedical nutrition coaching, education, accountability, and individualized nutrition recommendations for general health, wellness, and nonmedical weight control.

In providing these services, we collect information relating to nutrition, body composition, lifestyle, wellness, and Program eligibility. Some jurisdictions define this information broadly as “consumer health data.”

This Consumer Health Data Privacy Policy explains the consumer health data we collect, why we collect it, how we use and disclose it, and the choices and rights available to consumers.

This policy supplements the MacroRx+ Privacy Policy.

1. Consumer Health Data We Collect

Depending on your participation in MacroRx+, we may collect or derive consumer health data including:

Body and Body-Composition Information

This may include:

  • Height;
  • Current, starting, historical, and target weight;
  • Body mass index (BMI);
  • Body-fat information;
  • Lean-body-mass information;
  • Estimated basal metabolic rate (BMR);
  • Estimated total daily energy expenditure (TDEE);
  • Ideal or reference body-weight calculations; and
  • Other measurements or calculations derived from information you provide.

Nutrition and Lifestyle Information

This may include:

  • Calorie and macronutrient information;
  • Macro Prescriptions and adjustments;
  • Food intake and nutrition reports;
  • Food preferences;
  • Food allergies, sensitivities, or foods you avoid;
  • Activity level;
  • Appetite and hunger information;
  • Eating patterns;
  • Information concerning your response to particular foods or eating patterns;
  • Nutrition-tracking information you choose to provide; and
  • Information used in MacroRx+ metabolic-type or similar coaching calculations.

Progress and Coaching Information

This may include:

  • Weight history;
  • Progress measurements;
  • Weekly and daily nutrition reporting;
  • Macro Prescription history;
  • Coaching adjustments;
  • Information you provide to a coach;
  • Screenshots, charts, or reports you submit for coaching or accountability; and
  • Other information reasonably necessary to provide the Program you requested.

Program Eligibility Information

MacroRx+ may collect limited information to determine whether the Program is appropriate for you, including:

  • Date of birth or age;
  • Whether you are currently pregnant; and
  • Whether you currently have an active eating disorder.

These questions are used for Program eligibility and safety. MacroRx+ does not provide medical diagnosis or medical nutrition therapy.

2. Sources of Consumer Health Data

We collect consumer health data from:

  • You directly, including through intake forms;
  • Information you provide to MacroRx+ coaches;
  • Nutrition reports, screenshots, charts, or other information you submit;
  • Information you post or submit through the private member community;
  • Your ongoing progress reports and check-ins;
  • Calculations or inferences generated from information you provide, such as BMI, BMR, TDEE, estimated body composition, target ranges, and Macro Prescriptions; and
  • Third-party services you choose to use or information from those services that you choose to provide to MacroRx+.

3. Why We Collect and Use Consumer Health Data

We collect and use consumer health data as reasonably necessary to provide the MacroRx+ Program requested by you, including to:

  • Determine Program eligibility;
  • Establish your starting Macro Prescription;
  • Calculate calorie and macronutrient targets;
  • Provide individualized nonmedical nutrition recommendations;
  • Review nutrition reporting;
  • Monitor progress;
  • Adjust your Macro Prescription when appropriate;
  • Provide coaching, feedback, accountability, and behavior-change support;
  • Maintain continuity in your coaching relationship;
  • Respond to your questions and requests;
  • Maintain appropriate Program records;
  • Protect the security and integrity of our systems and services; and
  • Comply with applicable legal obligations.

We will not collect, use, or share additional categories of consumer health data or use consumer health data for materially different purposes where applicable law requires additional notice or affirmative consent without first providing that notice and obtaining the required consent.

4. Consumer Health Data We Share

MacroRx+ does not sell consumer health data.

We may disclose or make consumer health data available to processors and service providers when reasonably necessary to provide, operate, secure, or maintain the Program requested by you.

Depending on the service involved, the categories of consumer health data disclosed may include contact identifiers together with intake information, body measurements, nutrition information, progress information, coaching records, or related information necessary for the particular service.

We do not share consumer health data with third parties for their independent advertising or marketing purposes.

5. Categories of Processors and Other Recipients

Consumer health data may be processed by categories of service providers such as:

  • Cloud productivity and data-storage providers, including Google;
  • Website hosting and infrastructure providers, including Amazon Web Services;
  • Website form, database, and membership-management technology providers;
  • Email and communications providers, including Mailgun;
  • Security, backup, monitoring, and technical-support providers; and
  • Other processors reasonably necessary to operate the Program at your request.

Not every provider receives every category of consumer health data. We seek to limit access to information reasonably necessary for the service being performed.

Payment processors such as Stripe primarily process membership and payment information rather than the nutrition and coaching information described in this policy.

6. How Consumer Health Data Is Processed and Stored

Consumer health data may be maintained in systems used to operate MacroRx+, including:

  • Secure areas of our WordPress website and database;
  • Restricted Google Sheets or other cloud productivity systems used for member calculations and coaching records;
  • Communications used in the coaching relationship; and
  • Systems operated by service providers acting on our behalf.

Access is restricted to persons and service providers who reasonably need the information to provide requested services or operate and protect the Program.

7. Retention of Consumer Health Data

Complete intake records and substantive coaching records are generally retained while your membership is active and for up to three years after your membership ends.

We may retain particular information longer when reasonably necessary to comply with law, resolve disputes, protect against fraud or security incidents, establish or defend legal claims, or satisfy another legitimate and lawful recordkeeping requirement.

Different retention periods may apply to transaction, tax, accounting, security, and other records that are not retained principally as consumer health data.

When consumer health data is no longer reasonably necessary, we may delete or deidentify it.

8. Your Consumer Health Data Rights

MacroRx+ provides the following consumer health data rights to its members and consumers, subject to applicable law and reasonable identity verification.

You may request to:

  • Confirm whether MacroRx+ is collecting, sharing, or selling consumer health data concerning you;
  • Access consumer health data concerning you;
  • Receive information concerning the categories of consumer health data we collect;
  • Receive information concerning third parties or affiliates with whom your consumer health data has been shared, where applicable;
  • Withdraw consent for future collection or sharing where processing is based on your consent;
  • Request deletion of consumer health data concerning you; and
  • Appeal a refusal to act on a consumer health data request where applicable.

We will not unlawfully discriminate against you for exercising applicable consumer health data rights.

A request to stop collecting information that is necessary to provide your MacroRx+ coaching may mean that we can no longer provide some or all of the Program.

9. How to Exercise Your Rights

Please state that your message concerns a Consumer Health Data Privacy Request and describe the request you wish to make.

We may take reasonable steps to verify that the request relates to you before providing, correcting, or deleting consumer health data.

You are not required to create a new MacroRx+ account solely to submit a privacy request.

We will respond within the time required by applicable law. Where applicable, if we deny your request, we will provide information about how to appeal that decision.

10. Deletion Requests

When a valid deletion request applies, MacroRx+ will delete covered consumer health data from its records as required by applicable law and will take the steps required by applicable law concerning deletion requests directed to processors, affiliates, or other recipients.

Some information may be exempt from deletion or may be retained where applicable law permits or requires continued retention, including for security, fraud prevention, legal compliance, transactions, or legal claims.

Information stored in backups may require additional time to be fully removed through normal backup-retention cycles where permitted by law.

11. Security of Consumer Health Data

MacroRx+ maintains administrative and technical safeguards designed to protect the confidentiality, integrity, and availability of consumer health data appropriate to the nature and amount of information maintained.

We restrict access to consumer health data to persons and processors for whom access is reasonably necessary to provide requested services or fulfill the purposes described in this policy.

No electronic system can be guaranteed to be completely secure.

12. No Sale of Consumer Health Data

MacroRx+ does not sell consumer health data.

If our practices change in the future, we will update this policy and obtain any authorization required by applicable law before selling consumer health data.

13. Changes to This Policy

We may update this Consumer Health Data Privacy Policy when our services, data practices, technology, or legal obligations change.

If we propose to collect, use, or share consumer health data in a materially different manner requiring additional notice or consent under applicable law, we will provide the required notice and obtain required consent before engaging in that activity.

The effective date at the top identifies the current version.
